An introduction to the case

In 2004 The Natural Sapphire Company (NSC) hired TPS Inc, a website/software developer located in Mumbai India as a contractor to assist in software development for NSC’s online business. Over a 7 year period NSC paid TPS over $1,000,000 dollars (Exhibit 50). Eventually TPS was fired for incompetence. Owner of TPS turned cyber-terrorist-extortionist against NSC. Below is a summary of hardships NSC suffered under the relentless attacks of TPS, and then the failed efforts for the legal system to provide any relief.


Section 230 of the Telecommunications Act of 1996 effectively legalized online Extortion.  Google and other 3rd party publishers have immunity and do little to nothing to stem the proliferation of online defamation and extortion running rampant on the internet.  Even with a Federal Court Order, Google has zero obligation to do anything - there are few-to-no protections under the current laws in the USA for online defamation victims.    My crime was altering a genuine court order which was granted to NSC from a federal judge to remove proven online defamation. 
The alteration: I added additional Url's of online defamation that TPS continued to post about NSC.

Why did I add more urls instead of going back to the court to issue an updated court order? 

Google's legal department was near-impossible-to-communicate-with, inconsistent and often unresponsive over many attempts in asking them to honor the court's order of defamation relief.  Google will only occasionally remove links from their index if the exact link is listed in the court order.  After a court order is 30 days old (summary judgment), any new updates to a court order would be considered a new case, in other terms, wait another year and pay exorbitant legal fees...
And if you are willing to do that, there is still no end to the process repeating itself again and again...

Google has immunity and doesn't want to deal with these legal administrative headaches, they often outright ignore requests to honor a court order related to defamation.  Other online search companies like Yahoo and Bing offer absolutely nothing in way of seeking relief in their search results.

I was sentenced to 9 months prison and 5 months home detention. A $20,000 fine and 3 years probation, and a lifetime sentence of having my personal reputation damaged online. 
 

It is important to note that my actions hurt no-one. 
There were no victims.
No theft, no restitution to be paid, no money made in what I had done.

The justice department refused any and all request for leniency even when presented with over 65 exhibits of how NSC was brutally attacked and the extensive efforts to defend itself through proper legal channels.  The federal prosecutors, Google and judicial system where incredibly oppressive, disregarding the grave injustice under the circumstances and lack of protections under the current laws. 

Google made every effort to prosecute to the fullest (even as NSC has paid Google over 3 million dollars in advertising fees).  When NSC took action to protect its existence and hard working American families from losing their careers, Google's legal dept could care less.

The timeline below (with links to over 65 exhibits) is a FACTUAL account of an American company that was successfully extorted by a former Indian programmer hiding in Mumbai India  After a genuine Federal Court Order was obtained to remove immense proven defamation, Google was uncooperative, the FBI threw up their hands, local and State government were useless, Google makes billions and the small guys lose - this is the end result of this story.

In December 2010 NSC’s website and software systems had fallen into a state of disrepair. Over a prior 2 year period NSC had attempted to move its software and web development to American based programmers. [Indian terrorist name omitted], owner of (TPS) refused to cooperate with any other programmers outside of his organization. TPS continued to increase monthly billing and when NSC refused to agree to increase costs TPS would ‘break’ NSC’s systems and claim more payments were needed to attend to the issues. NSC was in a hostage situation.

In November/December 2010 TPS claimed that 2 of their best programmers quit working for TPS. Soon thereafter NSC’s systems were inoperable and TPS could not rectify the issues, NSC had no choice but to formally attempt to end any business with TPS. TPS demanded wide ranges of compensation from $150,000 to a high of 1 million dollars. Regardless of the fact that NSC had no overdue bills to TPS at the time of notice. There were no civil disputes at notice of discontinuous.

NSC informed TPS to turn over software source code. Prashant/TPS refused and immediately began a progressive and systematic attacks against NSC. Below is the defense NSC took to defend itself and the total failure of the current laws which give Google immunity in having to deal with any matters related to online defamation victims.

Extortion is unprotected and open for business online with no recourse.

This is a TRUE account of an American company that paid over 1 million dollars to an Indian programmer. When the business relationship was discontinued for poor quality work, the programmer became a cyber-extortion-terrorist hell-bent on destroying his former client. This was never a contractual disagreement or civil dispute of any kind, in any form.

NSC did everything in its power through what it believed was legal and legitimate means to protect its existence and keep honest hard working American families from losing their carriers. Google continues to reject any assistance to resolve these matters whatsoever, on the contrary they have made efforts in effect to support the immense stress and losses suffered by The Natural Sapphire Company and its employees.

Legal Challenges

Facing unjustified punishment after defending my company against cyber extorsion with what I believed was legal and legitimate.

When the business relationship was discontinued for poor quality work, the programmer became a cyber-extortion-terrorist hell-bent on destroying his former client.

NSC did everything in its power through what it believed was legal and legitimate means to protect its existence and keep honest hard working American families from losing their carriers.

Punishment WILL NEVER END for Michael Arnstein’s name/reputation when organic search results show him as a convicted felon, characterized as a criminal jeweler who allegedly tried to whitewash his reputation. This untruth is incredibly unjustified or warranted.
